This is our standard contract. A complete, personalized contract with your name, the animal's details, and purchase price will be provided for your specific transaction. By submitting an application and completing a purchase, you agree to these terms.

Premium Pet Purchase Agreement
(Pet-Only Contract)
This Pet Purchase Agreement ("Agreement") is entered into by and between:

This Agreement applies to the sale/adoption of the following animal ("Animal"):

The Animal is sold strictly as a companion/pet only. This Agreement establishes the terms and conditions under which the Buyer agrees to purchase and care for the Animal.
2.1 The Animal is sold STRICTLY as a pet.
2.2 Buyer acknowledges that no breeding rights are included or granted with this purchase.
2.3 Buyer agrees that the Animal shall NOT be used for breeding under any circumstances, intentional or accidental.
2.4 Buyer agrees not to sell, lease, or transfer the Animal to any party intending to breed the Animal.
3.1 Any unauthorized breeding of the Animal shall constitute a material breach of this Agreement.
3.2 In the event of breach, Seller reserves the right to pursue all remedies available under law and equity, which may include but are not limited to:
3.3 Buyer acknowledges that enforcement of this clause may vary depending on jurisdiction and applicable law.
Buyer agrees to provide the Animal with:
Failure to provide proper care may result in Seller pursuing rehoming or recovery where legally permissible.
5.1 Seller guarantees that the Animal is healthy at the time of transfer to the best of Seller's knowledge.
5.2 Buyer acknowledges that Seller is not responsible for future illness, injury, or conditions that may develop after transfer.
5.3 Buyer assumes full responsibility for all veterinary care and associated costs after purchase/adoption.
Because this Animal is sold as PET ONLY, Seller makes no guarantees regarding:
7.1 Buyer agrees not to rehome, resell, or transfer the Animal without first offering Seller the opportunity to reclaim or assist in placement.
7.2 If Buyer can no longer care for the Animal, Seller must be contacted first for possible return or rehoming assistance.
Seller retains the right of first refusal should Buyer decide to rehome or sell the Animal.
9.1 All deposits are non-refundable unless otherwise stated in writing by Seller.
9.2 Full payment must be completed prior to release of the Animal unless otherwise agreed.
Buyer assumes all risk once the Animal is transferred to Buyer or shipping carrier.
Seller is not liable for delays or issues caused by third-party transport services.
This Agreement is intended to be a legally binding contract. If any provision is found unenforceable in a court of law, the remaining provisions shall remain in full effect.
Any disputes shall be resolved under the laws of the Seller's operating jurisdiction unless otherwise required by law.

13.1 This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.
13.2 The parties agree that any legal action, dispute, or proceeding arising out of or related to this Agreement shall be brought exclusively in a court of competent jurisdiction located within the State of Texas, unless otherwise required by applicable law.
13.3 Buyer acknowledges that under Texas law, animals are generally considered personal property, and ownership rights are subject to the terms of this Agreement and applicable Texas statutes governing property and contract law.
13.4 Buyer agrees that Texas law permits enforcement of contractual agreements relating to the sale, transfer, and conditions of ownership of personal property, including companion animals, provided such terms are not in violation of public policy.
13.5 In the event of any dispute arising under this Agreement, the prevailing party shall be entitled to recover reasonable attorney's fees and court costs as allowed under Texas Civil Practice and Remedies Code, to the extent permitted by law.
13.6 If any provision of this Agreement is found to be unenforceable under Texas law, the remaining provisions shall remain valid and enforceable to the fullest extent permitted.
14.1 The Buyer and Seller agree that any dispute, claim, or controversy arising out of or relating to this Agreement, the Animal, or any transaction between the parties shall be resolved exclusively through final and binding arbitration.
14.2 Both parties expressly waive their right to bring or participate in any lawsuit in court, including the right to a jury trial, except as may be required for enforcement of an arbitration award.
14.3 Arbitration shall be conducted under the rules of the American Arbitration Association (AAA) or another mutually agreed arbitration service provider.
14.4 The arbitration shall take place in the State of Texas, unless both parties agree otherwise in writing.
14.5 The arbitrator's decision shall be final, binding, and enforceable in any court of competent jurisdiction.
14.6 The prevailing party in arbitration may be awarded reasonable attorney's fees, arbitration costs, and other applicable expenses as permitted by law.
14.7 This arbitration clause shall survive termination, transfer, or completion of this Agreement.
15.1 Notwithstanding the parties' agreement to resolve disputes through binding arbitration, Seller shall retain the right to seek temporary, preliminary, or permanent injunctive relief from a court of competent jurisdiction when Seller reasonably believes that immediate action is necessary to prevent irreparable harm or to preserve the status quo pending arbitration.
15.2 Such relief may include, but is not limited to, circumstances involving: unauthorized breeding of the Animal; attempted sale, transfer, or disposition of the Animal in violation of this Agreement; failure to comply with a lawful recovery or return provision of this Agreement; actions that may jeopardize the health, welfare, safety, or ownership status of the Animal; actions affecting offspring produced in violation of this Agreement.
15.3 The parties agree that a breach of the Pet-Only Restriction and No-Breeding provisions may result in damages that are difficult to calculate and may cause irreparable harm for which monetary damages alone may be inadequate.
15.4 The filing of a request for injunctive relief shall not waive the right or obligation of either party to submit the underlying dispute to binding arbitration pursuant to this Agreement.
15.5 Any court proceedings initiated under this section shall be limited solely to obtaining emergency or equitable relief, and all remaining claims shall be resolved exclusively through arbitration as provided herein.
15.6 The prevailing party in any action for injunctive relief or arbitration arising from enforcement of this Agreement shall be entitled to recover reasonable attorney's fees, costs, and expenses to the fullest extent permitted by Texas law.

The Buyer acknowledges that this Animal is being transferred as a pet only and that no breeding rights are granted.
The Buyer further acknowledges that they have received, reviewed, and agreed to the terms of the separate Pet Purchase Agreement executed between the parties.
